The Timothy Busfield scandal, who acted in “The West Wing” and “Thirtysomething,” moved from an investigation to trial in New Mexico because of allegedly committing criminal sexual contact with a minor and child abuse. A scandal that involves an experienced television actor brings to light again the steps that are being taken to protect young actors.

As per an accusation, Busfield inappropriately touched two young actors who just happened to be twin brothers while working on the crime show ‘The Cleaning Lady’ that aired on Fox late in 2022 and spring of 2024. The court documents show that at that age, the young actors were just seven and eight years old. The first boy felt that he was touched inappropriately in some private places that were covered, while the other was afraid to talk because of Busfield’s title of director.
The case began in November of 2024 with a concern expressed by employees of the University of New Mexico Hospital for possible grooming. The initial interviews did not produce any information concerning sexual contact, but it took nearly a year for the mother of the children to come forward with her worries for both of the boys when she contacted Child Protective Services.
Busfield denies all claims and claims that the accusations come from envy of the boys being excluded in the final season of the series. Busfield refers to an independent evaluation commissioned by Warner Bros., a co-production company for the series, and claims that no evidence of misconduct could be found. The prosecution argues that important witnesses were not surveyed for this evaluation and refer to a pattern of boundary crossing and grooming.
However, once the arrest warrant was issued, the Albuquerque Police Department called on assistance from the U.S. Marshals Service to locate Busfield, thinking that he might have left New Mexico. The U.S. Marshals Service, which annually apprehends thousands of high-profile fugitives, was called into action on January 12, 2026. The next day, Busfield turned himself in by returning to the state, appearing in court via a video conference call from jail. Busfield is currently being held without bail pending a detention hearing.
The crimes he is accused of are considered to be very grave offenses under New Mexico Law. The criminal sexual contact of a minor can lead to a mandatory minimum imprisonment of three years if found guilty. The crime can be defined as “unlawful and intentional touching of the child’s ‘intimate parts’ or causing the child to touch ‘the perpetrator’s intimate parts,’ clothed or unclothed as may be determined by the level of the crime.”
The allegations have already resulted in direct professional consequences for him. A scheduled episode of “Law & Order: Special Victims Unit” featuring Busfield has been cancelled by NBC, while Warner Bros. has stated that it will fully cooperate with the authorities. His wife, actress Melissa Gilbert, has stood by him in public but has elected not to comment further at his lawyers’ request. This case also raises concerns in the industry regarding child protection in a film setting. There has also been growing use of intimacy coordinators and stricter policies regarding physical intimacy in film settings.
At this time, there are SAG-AFTRA rules regarding the use of qualified intimacy coordinators in these physical scenes to ensure that there is also Nudity and Intimacy Contract compliance in the final film cut. While these rules and regulations primarily relate to adult physical scenes, it is also important to exercise this level of caution in instances where children are involved. As this case unfolds, it serves as a reminder of the difficulties that child actors face and the need for robust protections in the film industry, it said.
